6. data processing in the context of the internal reporting office in accordance with the Whistleblower Protection Act (HinSchG)
We offer whistleblowers various communication channels to receive information regarding suspected violations. Notices in this regard, including contact options for the reporting channels, are located on our company premises in places that are freely accessible to whistleblowers.
Personal data may be processed in the process. The categories of personal data (name, telephone number, e-mail, position, etc.) depend on the person making the report or the choice of communication channel.
The data is processed exclusively for the purpose of reviewing and documenting the reports, for internal investigations (including disclosure to external lawyers, auditors or other professionals bound by professional secrecy and to persons responsible in other parts of the Group – where applicable) and, if necessary, for disclosure to government agencies (e.g. police, public prosecutor’s office or courts). The legal basis for the processing is the fulfillment of legal obligations pursuant to Art. 6 para. 1 lit. c EU GDPR in conjunction with §10 and §12 HinSchG.
We ensure confidential processing for all persons providing information. This is based on the legal requirements of the Whistleblower Protection Act in §8 and §9.
The storage period is 3 years after completion of a procedure. The criterion for the duration of the storage of personal data is the respective statutory retention period in accordance with §11 HinSchG. Once this period has expired, the corresponding data is routinely deleted.
We use the service provider Datenschutz Consulting Dresden GmbH, Altmarkt 10c, 01067 Dresden, to provide the internal reporting office. This company manages the internal reporting office, provides legally required reporting channels and an expert ombudsperson. The legal basis for the processing is §12 and §14 HinSchG i.V.m. Art. 6 para. 1 lit. c EU GDPR.
